The Department of Communities is authorised to seek orders from the Children’s Court for the protection and care of children who have suffered, or are likely to suffer, harm as a result of neglect or abuse. The abuse can be physical abuse, emotional abuse, or sexual abuse.

Depending on the seriousness of the alleged abuse or neglect, the Department may seek an order for the children to remain living with their parents while they are supervised by a case worker, or an order for a child at risk to be placed in the care of the State of Western Australia. 

The removal of a child from their parents may last for up to 2 years or until the child turns 18 years of age. During that period, the child will either be placed with suitable members of their extended family or into foster care.
